NO PURCHASE NECESSARY HOW TO ENTER Entries received online shall be deemed to be submitted by the authorized account holder of the e-mail address associated with the entry. For the purpose of the Contest Rules, “authorized account holder" of an e-mail address is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain name associated with the submitted e-mail address. Each selected entrant may be required to provide the Sponsors with proof that the selected entrant is the authorized account holder of the e-mail address associated with the winning entry. Limit of one (1) entry per person. In the case of multiple entries, only the first eligible entry will be considered. The Sponsors of this Contest are HustleGRL Universal Music Canada Inc. (collectively, the “Sponsors”). CONTEST CLOSING DATE: To be eligible to win the Contest, entries must be received no later than 12:00am ET on April 23, 2010 (the “Contest Closing Date”). GRAND PRIZEThere will be one (1) grand prize package (the “Grand Prize”) available to be won. The Grand Prize consists of:
Approximate retail value of the Grand Prize is six hundred and thirty Canadian dollars ($630 CDN). The Grand Prize as described is subject to availability, may not be exchanged for cash, is non-transferable, non-refundable, may not be sold, and must be accepted as awarded, without substitutions. At their election, and in the event the Grand Prize, or any portion thereof, cannot be awarded as described in these Official Rules, the Sponsors reserve the right to substitute a prize of equivalent retail value. Sponsors will not be responsible if weather conditions or other factors beyond Sponsors’ reasonable control prevent the Grand Prize or part of the Grand Prize from being fulfilled. SECONDARY PRIZES One (1) Grand Prize winner (the “Grand Prize Winner”) shall be selected as follows: on or about April 30, 2010 at the Universal Music Canada offices located at 2450 Victoria Park Avenue, Suite 1, Toronto, Ontario M2J 5H3, the three (3) entries that have received the most votes before the Contest Closing Date will be reviewed; the Grand Prize Winner will be selected on the merits of their being the Young Money Apprentice as outlined in their submitted essay. The remaining two (2) entrants will be declared the Secondary Prize Winners. Each entrant shall be eligible to win only one (1) prize. Before being declared a Winner, the selected entrant shall be required to comply with the Contest Rules. Judges shall determine the Grand Prize Winner based on the content and quality of the Work provided by each entrant. The judges, in their absolute discretion, shall select the Grand Prize Winner based upon the above criteria. The decisions of the judges shall be final and binding and may not be challenged in any way. THE WINNERS WILL BE NOTIFIED BY TELEPHONE or E-MAIL AND MUST RESPOND WITHIN THREE (3) BUSINESS DAYS OF NOTIFICATION. Upon notification, the selected entrant must respond by telephone to the contact number provided in the notification, and the selected entrant’s response must be received by the Sponsors within three (3) business days of such notification. If the selected entrant does not respond in accordance with the Contest Rules, he/she will be disqualified and will not receive a Prize and another entrant may be selected in the Sponsors’ sole discretion until such time as an entrant satisfies the terms set out herein. The Sponsors are not responsible for the failure for any reason whatsoever of a selected entrant to receive notification or for the Sponsors to receive a selected entrant’s response. If, as a result of an error relating to the entry process, drawing or any other aspect of the Contest, there are more selected entrants than contemplated in these Contest Rules, there will be a random draw amongst all eligible Prize claimants after the Contest’s closing date to award the correct number of Prizes. All decisions of the judges are final in all matters relating to this Contest. ELIGIBILITYTo be eligible for this Contest, an individual must: (a) be a legal resident of Canada; (b) be between the ages of sixteen (16) and twenty-one (21) at the time of entry; and (c) be the sole owner of all right, title and interest (including copyright) in and to the Work (as defined above) submitted in connection with the Contest; Employees of the Sponsors, their respective affiliates, subsidiaries, related companies, advertising and promotional agencies, judges of the Contest and any other parties engaged in the development, production or distribution of the Contest materials and the household members of any of the above, are not eligible to participate in the Contest. The Sponsors have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsors for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. The Sponsors reserve the right, in their sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information. GENERAL CONDITIONSBy participating in this Contest, entrants represent and warrant that: (i) the Work does not contain any material that is libelous, defamatory, profane or obscene; (ii) the Work is original and all right, title, and interest (including copyright) is owned and/or controlled by the entrant to the full extent necessary to enable the Sponsors to use the Work as contemplated by these Contest rules; and (iii) the Work does not infringe upon the intellectual property or other statutory or common law rights of any third party. All entries, including the Work, become the sole property of the Sponsors and none will be returned for any reason. Entries must be received no later than the Contest Closing Date. Entries will be declared invalid if they are late, illegible, incomplete, damaged, irregular, mutilated, forged, garbled or mechanically or electronically reproduced. No communication or correspondence will be exchanged with entrants except with those selected for a Grand Prize. By entering the Contest, entrants consent to the use of their name, city of residence and image on videotape and/or photograph in any publicity carried out by any one or all of the Sponsors with respect to this Contest, without further notice or compensation. By entering this Contest electronically and voluntarily providing your personal information, entrants consent and agree to the Sponsors’ collection and use of the entrant’s information for the administration of this Contest and agree to Sponsors’ use of entrant information for the purpose of contacting entrant in relation to this Contest. Entrant’s information may be revoked at any time (without revoking entrant’s participation in the Contest or impairing entrant’s chances of winning) by writing to the Sponsors at the address above. By participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Contest Rules and Regulations, including eligibility requirements. Entrants release and hold harmless the Sponsors, their respective parent, related and affiliated companies, subsidiaries, members, dealers, advertisers, franchisees, promotional agencies and each of their respective directors, successors, sponsors, partners, licensees, officers, subsidiaries, agents, employees, artists, advisors, assignees, and all others associated with the development and execution of the Contest, from and against any and all manner of action, causes of action, suits, debts, covenants, contracts, claims and demands, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach and liability for physical injury, death, or property damage which the entrants or his/her administrators, heirs, successors or assigns might have or could have, by reason of or arising out of the entrant’s participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of the Grand Prize or Secondary Prize awarded. Entrants release and hold harmless the Sponsors, their respective parent, related and affiliated companies, their subsidiaries, advertising or promotional agencies and directors, officers, agents, artists, employees and all others associated with the development and execution of the Contest, from and against any and all liability with respect to or in any way arising from the Contest and the awarding, use, or misuse of any prize awarded, including liability for personal injury or damage to property. The Sponsors are not responsible for incorrect or inaccurate entry information which may affect a person’s ability to participate in the Contest or be awarded a prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, mail failures, omission, or any combination thereof, and entries which fail to fully comply with these Contest Rules and Regulations. No responsibility will be taken by the Sponsors for lost, delayed, mutilated or misdirected entries or Declaration and Release Forms. The Sponsors reserve the right, in their sole discretion; to cancel or suspend this Contest without notice should any cause beyond the reasonable control of the Sponsors corrupt the security or proper administration of the Contest. Any attempt to deliberately undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are forged, falsified, altered or tampered with in any way. Québec residents please note: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux du Québec (the “RACJ”) for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. Sponsors reserve the right (subject to the approval of the RACJ, if required, in respect of the Province of Quebec) to suspend, modify or terminate this Contest at any time, for any reason, without any prior notice. The Sponsors also reserve the right to amend or modify these Rules at any time during the Contest without any prior notice. The Sponsors respect your right to privacy and will use your personal information only to conduct the Contest. The Contest is subject to all applicable Federal, Provincial and Municipal laws. |
